Terms of Service

1. Purpose

These Terms govern your use of the iOS application "baton." (the "App") provided by beside Co. (the "Company").

2. Nature of the Service

  1. The App is a focus timer and log that runs on your device.
  2. The App is used without any account, and all data you create (session records, baton texts, and so on) is stored only on your device. The Company cannot access this data.

3. Effect and Changes to These Terms

  1. These Terms take effect when posted within the App and on the website.
  2. The Company may amend these Terms in compliance with applicable law, giving notice on the website at least 7 days before the effective date (30 days for changes unfavorable to users).

4. Paid Features and Payment

  1. Certain features ("Full Track") are offered as a one-time in-app purchase through the Apple App Store, where Apple is the seller of record.
  2. Payment, billing, and refunds are handled by Apple under Apple's Media Services Terms and App Store policies. Refunds must be requested through Apple, and the Company cannot influence Apple's refund decisions.
  3. "Full Track" is a one-time purchase, not a subscription, and can be restored free of charge when reinstalled on the same Apple account.

5. Software License

The Company grants you a non-transferable, non-exclusive license to use the App. The App is also subject to Apple's Licensed Application End User License Agreement; where it conflicts with these Terms, the provision more favorable to you prevails.

6. User Responsibility

  1. You are responsible for the content of the text and records you enter into the App, and for backing them up.
  2. Data may be lost when you change or reset your device or delete the App. Because the Company keeps no server copy, it cannot recover such data. The App provides a data export feature.

7. Intellectual Property

Rights to the App and its components (design, trademarks, text, and so on) belong to the Company. Rights to the content you create, such as your baton texts, belong to you.

8. Disclaimer and Limitation of Liability

  1. The App is provided "as is," and the Company makes no warranty of fitness for a particular purpose.
  2. For free features, the Company is not liable for damages absent intent or gross negligence. For paid features, the Company's liability is limited, to the extent permitted by applicable law, to the amount you paid.
  3. This section does not limit any rights you have under mandatory consumer protection law.

9. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Korea, and disputes are brought before the court with jurisdiction under the Civil Procedure Act. Consumers retain any venue guaranteed by mandatory law.
