이용약관

제1조 (목적)

본 약관은 beside Co.(비사이드 코퍼레이션, 이하 "회사")가 제공하는 iOS 애플리케이션 "baton."(이하 "앱")의 이용 조건과 회사·이용자의 권리, 의무를 정합니다.

제2조 (서비스의 성격)

1. 앱은 이용자의 기기 내에서 동작하는 집중 타이머 및 기록 도구입니다.
2. 앱은 계정 가입 없이 사용하며, 이용자가 생성한 모든 데이터(세션 기록, 바통 텍스트 등)는 이용자 기기에만 저장됩니다. 회사는 해당 데이터에 접근할 수 없습니다.

제3조 (약관의 효력 및 변경)

1. 본 약관은 앱 내 및 웹사이트에 게시함으로써 효력이 발생합니다.
2. 회사는 「약관의 규제에 관한 법률」 등 관련 법령을 위반하지 않는 범위에서 약관을 개정할 수 있으며, 개정 시 시행일 7일 전(이용자에게 불리한 변경은 30일 전) 웹사이트에 공지합니다.

제4조 (유료 기능 및 결제)

1. 앱의 일부 기능("풀 트랙")은 Apple App Store를 통한 일회성 인앱 구매로 제공됩니다. App Store를 통한 판매에서 이용자와의 거래 당사자(판매자)는 Apple이며, 결제·청구·환불은 Apple의 미디어 서비스 약관 및 App Store 정책에 따릅니다.
2. 환불(청약철회 포함)은 Apple을 통해 요청해야 하며, 회사는 Apple의 환불 결정에 관여할 수 없습니다. 디지털 콘텐츠의 특성상 이미 사용을 개시한 부분에 대해서는 관련 법령이 정한 범위에서 청약철회가 제한될 수 있습니다.
3. "풀 트랙"은 구독이 아닌 1회 결제 상품이며, 동일한 Apple 계정에서 재설치 시 무료로 복원할 수 있습니다.

제5조 (소프트웨어 라이선스)

회사는 이용자에게 앱을 이용할 수 있는 양도 불가능·비독점적 라이선스를 부여합니다. App Store를 통해 제공되는 앱에는 Apple의 「라이선스 응용 프로그램 최종 사용자 사용권 계약(Licensed Application End User License Agreement)」이 함께 적용되며, 본 약관과 상충하는 경우 이용자에게 유리한 조항이 우선합니다.

제6조 (이용자의 책임)

1. 이용자가 앱에 입력한 텍스트 및 기록의 내용과 그 백업에 대한 책임은 이용자에게 있습니다.
2. 기기 변경·초기화·앱 삭제 시 데이터가 소실될 수 있으며, 회사는 서버 사본을 보유하지 않으므로 복구할 수 없습니다. 앱은 데이터 내보내기 기능을 제공합니다.

제7조 (지식재산권)

앱과 그 구성요소(디자인, 상표, 텍스트 등)에 대한 권리는 회사에 있습니다. 이용자가 작성한 바통 텍스트 등 콘텐츠의 권리는 이용자에게 있습니다.

제8조 (보증의 부인 및 책임 제한)

1. 앱은 "있는 그대로" 제공되며, 회사는 특정 목적 적합성에 대해 보증하지 않습니다.
2. 회사는 무료 제공 기능과 관련하여 고의 또는 중대한 과실이 없는 한 손해에 대해 책임을 지지 않으며, 유료 기능과 관련한 책임은 관련 법령이 허용하는 범위 내에서 이용자가 지불한 금액을 한도로 합니다.
3. 본 조는 소비자 보호 관련 강행법규상 이용자의 권리를 제한하지 않습니다.

제9조 (준거법 및 관할)

본 약관은 대한민국 법률에 따르며, 분쟁은 「민사소송법」상 관할 법원에 제기합니다. 다만 소비자는 강행법규가 보장하는 관할을 선택할 수 있습니다.

4. App Store를 통한 유료 판매의 판매자는 Apple이며, 결제·환불 관련 통신판매 정보는 Apple App Store에 귀속됩니다. 회사의 주소 등 사업자 상세 정보는 위 이메일로 요청 시 지체 없이 제공합니다.

1. Purpose

These Terms govern your use of the iOS application "baton." (the "App") provided by beside Co. (the "Company").

2. Nature of the Service

The App is an on-device focus timer and log. It requires no account, and all data you create (sessions, baton texts) is stored only on your device. The Company has no access to your data.

3. Changes to Terms

The Company may amend these Terms in compliance with applicable law, with at least 7 days' notice on the website (30 days for changes unfavorable to users).

4. Paid Features & Payment

Certain features ("Full Track") are offered as a one-time in-app purchase through the Apple App Store, where Apple is the seller of record. Billing, charges, and refunds are handled by Apple under Apple's Media Services Terms; the Company cannot process refunds directly. Full Track is a one-time purchase, not a subscription, and can be restored free of charge on the same Apple account.

5. Software License

The Company grants you a non-transferable, non-exclusive license to use the App. The App is also subject to Apple's Licensed Application End User License Agreement; where it conflicts with these Terms, the provision more favorable to you prevails.

6. User Responsibility

You are responsible for the content you enter and for backing up your data. Because the Company keeps no server copy, data lost through device change, reset, or app deletion cannot be recovered. The App provides an export feature.

7. Intellectual Property

The App and its components belong to the Company. Content you create belongs to you.

8. Disclaimer & Limitation of Liability

The App is provided "as is." To the maximum extent permitted by law, the Company's liability for paid features is limited to the amount you paid. Nothing in these Terms limits rights you have under mandatory consumer protection law.

9. Governing Law

These Terms are governed by the laws of the Republic of Korea. Consumers retain any venue guaranteed by mandatory law.
